These Terms of Use ("Terms") govern your use of the MedMiles mobile application ("App") operated by Samuel Canales ("we," "us," or "our"). By downloading, installing, or using MedMiles, you agree to these Terms.
By creating an account or using MedMiles, you confirm that you are at least 18 years old and agree to be bound by these Terms. If you do not agree, do not use the App.
MedMiles is an expense tracking and tax estimation tool designed for 1099 independent contractor medical professionals. The App allows you to log trips, income, meals, monthly bills, credentials, and generate estimated tax calculations and PDF reports.
MedMiles does not provide tax, legal, or financial advice. All tax calculations, deduction estimates, and quarterly payment estimates are approximations for informational purposes only. They should not be relied upon for tax filing or financial decisions. You should consult a qualified Certified Public Accountant (CPA) or tax professional for accurate tax advice and filing.
We make no guarantees about the accuracy of tax estimates. Tax laws change frequently, and individual circumstances vary. MedMiles is a record-keeping tool, not a tax preparation service.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate information when creating your account.
MedMiles offers a free tier and a Pro subscription with additional features. Pro subscriptions are available as monthly or annual plans.
You retain ownership of all data you enter into MedMiles. We do not claim any rights to your financial data, receipt images, or personal information beyond what is necessary to provide the service. See our Privacy Policy for details on data handling.
You agree not to:
MedMiles is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by applicable law, Samuel Canales and MedMiles expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, non-infringement, and any warranties arising from course of dealing or usage of trade.
Without limiting the foregoing, we make no warranty or representation that: (a) the App will meet your requirements or expectations; (b) the App will be uninterrupted, timely, secure, or error-free; (c) any tax estimates, calculations, deduction amounts, or financial information provided by the App will be accurate, complete, or current; (d) any data you enter into the App will be preserved, backed up, or protected from loss; or (e) the App will be compatible with any particular device or operating system version.
You acknowledge and agree that you use MedMiles entirely at your own risk. You are solely responsible for verifying all information, tax estimates, and calculations provided by the App with a qualified tax professional or CPA before making any financial decisions or filing any tax returns.
To the maximum extent permitted by applicable law, in no event shall Samuel Canales, MedMiles, or any of its affiliates, officers, agents, partners, or licensors be liable to you or any third party for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, including but not limited to damages for loss of profits, revenue, data, goodwill, or other intangible losses, regardless of whether such damages are based on contract, tort (including negligence), strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
Without limiting the foregoing, our total cumulative liability for all claims arising out of or relating to these Terms or your use of the App shall not exceed the greater of (a) the amount you have paid to us in subscription fees during the twelve (12) months immediately preceding the event giving rise to the claim, or (b) fifty U.S. dollars ($50.00).
You specifically acknowledge that Samuel Canales and MedMiles shall not be liable for: (a) inaccurate tax estimates, calculations, or deduction amounts; (b) missed tax deadlines or penalties resulting from reliance on the App; (c) any financial decisions made based on information provided by the App; (d) loss, corruption, or unauthorized access to your data; (e) errors in mileage tracking, income records, expense categorization, or any other data entry; (f) any damages resulting from your failure to maintain adequate backups of your data; or (g) any third-party claims arising from your use of the App.
You expressly acknowledge and agree that you bear sole and exclusive responsibility for all data, information, and content that you enter into, store in, or generate through MedMiles. You assume all risk associated with your use of the App and any reliance on its outputs, including all tax estimates, reports, and calculations.
You agree that MedMiles is a record-keeping and estimation tool only, and that no output of the App constitutes professional tax advice, legal advice, financial advice, or any other form of professional counsel. You are solely responsible for the accuracy and completeness of all information you provide to the App and for independently verifying all outputs before relying on them for any purpose.
You agree to indemnify, defend, and hold harmless Samuel Canales, MedMiles, and any affiliated parties from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any tax filing, financial decision, or other action you take based on information provided by the App; (e) any content or data you submit to or through the App; or (f) your negligence or willful misconduct. This indemnification obligation shall survive the termination of these Terms and your use of the App.
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
You and Samuel Canales agree that any dispute, claim, or controversy arising out of or relating to these Terms, the App, or your use of MedMiles (collectively, "Disputes") shall be resolved exclusively through final and binding individual arbitration, rather than in court, except that either party may bring an individual action in small claims court if the claim qualifies.
Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration shall take place in the State of California, or at another mutually agreed location, or via telephone or video conference if permitted by the arbitrator. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
You agree that any arbitration shall be conducted on an individual basis only, and not as a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and Samuel Canales each waive any right to a jury trial.
YOU AND SAMUEL CANALES AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and Samuel Canales agree otherwise in writing, the arbitrator may not consolidate or join more than one person's claims and may not otherwise preside over any form of a class, collective, or representative proceeding.
By using MedMiles, you voluntarily and knowingly waive, to the fullest extent permitted by law, any and all claims, causes of action, and rights to seek damages of any kind against Samuel Canales and MedMiles arising from or related to your use of the App, except to the extent such waiver is prohibited by applicable law.
Receipt photos and documents are stored locally on your device and are not backed up to our servers. We are not responsible for data loss due to device damage, loss, or failure. We recommend enabling iCloud backups to protect your data. You acknowledge that you are solely responsible for maintaining backups of your data and that Samuel Canales and MedMiles shall have no liability for any loss of data regardless of cause.
We reserve the right to modify these Terms at any time. Changes will be reflected by updating the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
We may suspend or terminate your account at any time for violation of these Terms. Upon termination, your right to use the App ceases immediately. You may request deletion of your account data by contacting us. Sections 8 through 14 of these Terms shall survive any termination.
If any provision of these Terms is found to be unenforceable or invalid by a court or arbitrator, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Samuel Canales regarding your use of MedMiles and supersede all prior agreements and understandings, whether written or oral.
